Trademark registration in Argentina. Argentina or the Republic of Argentina is the country with the third-largest economy in Latin America after Brazil and Mexico. Argentina is a highly potential but also a very competitive market for businesses. Therefore, it is crucial for businesses to register a trademark in Argentina to develop and expand their activities to this market.

Registering a trademark in Argentina allows the applicants to protect the company logo, product name, or any other sign that distinguishes products/services between individuals or organizations.

Necessary documents for trademark registration in Argentina

  • Authorization letter that is notarized, translated, authenticated, and consular legalized by the Embassy of Argentina;
  • Sample of the trademark application for registration;
  • Details of the list of goods/services claimed for protection;
  • Name and address of the applicant in English;
  • Copy of the document proving the right of priority, translated into Spanish certified by an Argentine translator (if any).

Trademark registration process in Argentina

  • A trademark application can only be associated with a group of goods/services.
  • After submission, the trademark application will be examined in form and content within 6-8 months;
  • If no grounds for refusal are found, the Trademark Agency will proceed to publish the mark within 30 days for the third party to exercise the right to object.
  • If no objection is filed within the above time limit, the trademark will be officially granted a protection certificate in Argentina.
  • The term of validity of a protection certificate is 10 years from the date the trademark is granted the protection certificate and can be renewed unlimitedly for an additional period of 10 years each time with the condition that renewal is requested, accompanied by an Affidavit. Affidavit of Use of Trademark (Affidavit of Use of Trademark) must be filed within 6 months prior to the expiration date. Argentina does not accept a late extension like many other countries. However, the Argentine Trademark Agency accepts the submission of a renewal request within the first 2 hours of the next working day immediately following the date of expiration of the trademark.

Trademark approval time in Argentina 

In the absence of objective complaints such as no objection from the Trademark Agency and/or objections from a third party, it will take approximately 16-18 months from the date of filing the application until the trademark is granted protection certificate in Argentina.
