Registration of industrial designs in Thailand – Every company that owns an industrial design and intends to expand its business in the market in Thailand should use Thailand’s intellectual property system. It is paramount for businesses to file an industrial design application in Thailand for industrial designs, even if the launch of the respective product on the market in Thailand has not yet commenced. 

Requirements for industrial design registration application in Thailand

Within six months after the priority date, an industrial design application can be filed claiming priority. The restoration of this term is not possible.

The official language when registering an industrial design at the Thailand Intellectual Property Office is Thai

The following information and documents need to be provided in the application for registration of an industrial design in Thailand: 

  • name, address, and nationality of the applicant, business address; 
  • class number according to the Locarno Classification;
  • title of the designs;
  • drawing of the designs.

If priority is requested, a certified copy of the priority document should be translated into Thai and submitted to the IP office before the publication of the design in the official gazette. 

The notarized Power of Attorney must be submitted within 90 days from the filing date. There is a surcharge for late filing of this document.

The original and notarized Deed of Assignment must be submitted concurrently with filing, or within 90 days by paying the fee if the applicant is not the designer. The Statement of Applicant’s Rights must be delivered within the same time frames whether the applicant is the designer. There is no need for the notarization of this document.

Examination of an industrial design application in Thailand

 An industrial design registration application in Thailand will go through the substantive examination process.

Validity period and renewal of industrial designs in Thailand

The renewal period for the novelty of an industrial design in Thailand is not stipulated. 

In Thailand, industrial designs are valid for 10 years after the date of filing. Beginning with the first day of the fifth year of the patent’s validity period, the first maintenance payments are due. The maintenance costs must be paid within 60 days of the patent grant date if the design patent is granted at the start of the fifth year.
