Registration of industrial designs in Saudi Arabia – Every company that owns an industrial design and intends to expand its business in the Saudi Arabian market should use the Saudi Arabia intellectual property system. It is paramount for businesses to file an industrial design application in Saudi Arabia for industrial designs, even if the launch of the respective product on the market in Saudi Arabia has not yet commenced. 

Requirements for Industrial Design Registration Application in Saudi Arabia

An industrial design application in Saudi Arabia requesting the right of priority must be filed within 6 months from the priority date.

The following information and documents need to be provided in the application for registration of an industrial design in Saudi Arabia: 

  • name, address, and nationality of the applicant, business address; 
  • request for design registration;
  • the title, description, and classes according to the International Classification of Industrial Designs;
  • representation of a design.

Original Power of Attorney notarized and apostilled should be provided at the time of filing an application or within 3 months from the filing date.

For industrial design applications where the priority is to be claimed it is necessary to provide the certified copy of the priority document within 3 months from the filing date.

An apostilled Assignment Deed between the applicant and the designer must be provided together with the application if it is filed with a person other than the designer.

Validity period and renewal of industrial designs in Saudi Arabia

It does not invalidate novelty if the design was disclosed at an officially recognized international exhibition within six months of the application filing date, or as a result of abusive acts committed against the applicant or his or her predecessor within six months of the application filing date or the date of priority, if any.
Within 90 days of the Office’s notice, the grant fee and publishing fee must be paid concurrently. In Saudi Arabia, the industrial design has a 10-year maximum validity period starting on the filing date. There is no chance for an extension. Annual maintenance costs must be paid between January 1 and March 31 of every year, beginning with the year after the filing date.
