Registration of industrial designs in Georgia – Every company that owns an industrial design and intends to expand its business in the Georgia market should use the Georgia intellectual property system. It is paramount for businesses to file an industrial design application in Georgia for industrial designs, even if the launch of the respective product on the market in Georgia has not yet commenced. 

Requirements for Industrial Design Registration Application in Georgia

An industrial design application in Georgia requesting the right of priority must be filed within 6 months from the priority date. The restoration of this term is not possible.

  • request for design registration;

A power of attorney may be provided at the time of application or within two months from the filing date. Legalization or notarization is not required.

For industrial design applications where the priority is to be claimed, it is necessary to provide a certified copy of the priority document within 3 months of the filing of the application.

Examination of an Industrial Design Application in Georgia

The request to conduct the substantive examination, as well as the payment of the examination fee, should be submitted to the patent office within 2 months of the notification of positive results of the formal examination.

Validity period and renewal of industrial designs in Georgia

Six months from disclosure of information about the industrial design before the application filing does not disprove the novelty of the industrial design according to the Georgia legislation.

The validity term of the patent for the industrial design in Georgia constitutes 10 years as of the filing date. This term may be renewed three times for five years up to a maximum of 25 years.

The official fees for grant and publication as well as the first post-grant annuities must be paid within three months from issuance of the decision to grant a patent or within two months from the publication of the patent.
