Patent registration in Uzbekistan – Any company that owns a patent and intends to expand its business in the Uzbek market or create long-term value and find investors for their patent or license their patents in the future should use the Uzbek patent system. It is paramount for businesses to file a patent application in Uzbekistan for inventions, even if the launch of the respective product on the Uzbek market has not yet commenced.
Deadline for filing a patent application in Uzbekistan
The time limit for filing a patent application in Uzbekistan claiming priority is 12 months from the date of priority being granted. This period can be extended for 2 more months after the expiry of the 12-month period.
Requirement or patent application in Uzbekistan
Applications must be submitted in Uzbek or Russian. If the application is submitted in any other foreign language, a translation into Uzbek or Russian must be provided within two months from the date of application.
The following information and documents must be provided in the application for patent registration in Uzbekistan:
- patent request with the name of the invention and applicant information;
- description, claims, and abstracts of the invention;
- drawings (if any).
- Certified copies of the priority document must be provided within three months of the application date. The priority application must be translated into Uzbek or Russian.
A signed Power of Attorney (PoA) must be provided at the same time as the application is submitted. If the applicant is a legal entity, a signed and stamped Power of Attorney must be provided to the Patent Office of Uzbekistan upon application. There is no need for formal legalization or PoA notarization.
Examination of patent applications in Uzbekistan
A request to conduct a substantive examination must be filed within three years of the patent application’s filing date in Uzbekistan.
Patent validity and renewal
The official licensing fee must be paid within three months of the issuance of the Patent Notice. The patent maintenance fee will be charged from the 3rd year, and the maintenance fee before the third year will also be collected during the above period. All maintenance fees for subsequent years will be charged from the date of application and must be paid by the date of annual filing.
The publication of information on the industrial design within six months prior to the filing of the application shall not preclude the novelty of the industrial design under the laws of Uzbekistan. Applications for registration of multiple industrial designs can be filed in Uzbekistan if the industrial designs relate to the same subject matter or can be identified as a commodity and have a single design concept.
Patents in Uzbekistan will be valid for 20 years.
