Registration of industrial designs in Morocco – Every company that owns an industrial design and intends to expand its business in the Morocco market should use the Morocco intellectual property system. It is paramount for businesses to file an industrial design application in Morocco for industrial designs, even if the launch of the respective product on the market in Morocco has not yet commenced. 

Requirements for Industrial Design Registration Application in Morocco 

An industrial design application in Morocco requesting the right of priority must be filed within 6 months from the priority date.  It is possible to restore this term within three months of the missed deadline.

The following information and documents need to be provided in the application for registration of an industrial design in Morocco: 

  • name, address, and nationality of the applicant, business address; 
  • request for design registration;
  • three copies of a graphic or photographic reproduction of the industrial designs, as well as the title and brief description of the relevant graphic or photographic reproductions;
  • description of a design.
Within three months after the filing date, a copy of a simple signed Power of Attorney should be filed. This period can be extended for another two months by paying an extra fee. Legalization/notarization is not required.
If priority is claimed, the priority document must be submitted to the Patent Office within three months of the design application’s filing date. The priority document must be translated into French.

In Morocco, industrial design applications are based only on the results of the formal examination; no substantive examinations are conducted.

Validity period and renewal of industrial designs in Morocco

In Morocco, the novelty grace period is specified. It is 12 months prior to the filing of the application or, if claimed, prior to the priority date.
Industrial design registration in Morocco is valid for five years from the date of application. It is renewable for two more five-year terms. The registration must be renewed six months before its period of validity expires. Renewal payments may only be made six months before the design registration expires, and there is a six-month grace period.
