Registration of industrial designs in Moldova – Every company that owns an industrial design and intends to expand its business in the Moldova market should use the Moldova intellectual property system. It is paramount for businesses to file an industrial design application in Moldova for industrial designs, even if the launch of the respective product on the market in Moldova has not yet commenced. 

Requirements for Industrial Design Registration Application in Moldova

An industrial design application in Moldova requesting the right of priority must be filed within 6 months from the priority date. 

The following information and documents need to be provided in the application for registration of an industrial design in Moldova: 

  • name, address, and nationality of the applicant, business address; 
  • request for design registration;
  • representation of a design.
If the applicant is a natural person, the Power of Attorney must be simply signed; if the applicant is a legal entity, it must be signed and stamped. The PoA must be filed concurrently with the filing or no later than three months after the filing date.

For industrial design applications where the priority is to be claimed, it is necessary to provide the certified copy (Romanian language) of the priority document within 3 months of filing the application.

Examination of an Industrial Design Application in Moldova

A Moldovan industrial design application should request substantive examination at the same time as filing the application.

Validity period and renewal of industrial designs in Moldova

12 months from disclosure of information about the industrial design before the filing of the application does not disprove the novelty of the industrial design according to the Moldova legislation.

Within three months after the date on which you received the Notice of Allowance, you must pay the official fees. A registered industrial design has five years of legal protection starting on the application filing date. A registration certificate’s validity may be increased four times, each for a period of five years, for a total extension period of 25 years, beginning on the application filing date.
