Registration of industrial designs in Indonesia – Every company that owns an industrial design and intends to expand its business in the Indonesian market should use the Indonesian intellectual property system. It is paramount for businesses to file an industrial design application in Indonesia for industrial designs, even if the launch of the respective product on the market in Indonesia has not yet commenced.
Requirements for Industrial Design Registration Application in Indonesia
An industrial design application in Indonesia requesting the right of priority should be filed within 6 months from the priority date. It is possible to restore the deadline within three months.
The following information and documents need to be provided in the application for registration of an industrial design in Indonesia:
- name, address, and nationality of the applicant, business address;
- request for design registration;
- representation of a design.
At the time of filing, a signed power of attorney must be included as a scanned copy. Legalization and notarization are not required.
A scanned copy of the Assignment Deed between the applicant and designer that has been notarized must be included with the application if it is filed by someone other than the designer. The Assignment Deed may be provided three months following the applicant’s application’s filing date. Also required is the Statement on Ownership.
Within three months after the filing date, a colored scanned copy of the certified priority document could be filed. If the priority application is submitted in a language other than English, an English translation is necessary.
Examination of an Industrial Design Application in Indonesia
Applications for designs are examined for formality requirements in Indonesia. After that, a three-month opposition period for the application is announced. Only in the event that an objection to an application is submitted, is substantive examination concludes within six months after the opposition period’s conclusion.
Validity period and renewal of industrial designs in Indonesia
In Indonesia, the novelty grace period is six months prior to the filing date or, if priority is claimed, the priority date.
Upon receiving the Notice of Allowance, the official filing fee for a design certificate must be paid within one month. Industrial designs that are filed with the Indonesian IP Office are valid for ten years after that. Maintenance fees are not relevant because there is no option for renewal.
