Registration of industrial designs in Denmark – Every company that owns an industrial design and intends to expand its business in the market in Denmark should use the Denmark intellectual property system. It is paramount for businesses to file an industrial design application in Denmark for industrial designs, even if the launch of the respective product on the market in Denmark has not yet commenced. 

Requirements for industrial design registration application in Denmark

An industrial design application in Denmark requesting the right of priority must be filed within 6 months from the priority date. This period cannot be extended. 

The official language when registering an industrial design at the Denmark Intellectual Property Office is Danish. Design applications may be filed in any language; however, a translation into Danish must be submitted within 3 months from the date of application. 

The following information and documents need to be provided in the application for registration of an industrial design in Denmark: 

  • name, address, and nationality of the applicant, business address; 
  • indication of classes comprising the product according to the Locarno Agreement;
  • product specification;
  • design drawings. 

A copy of the simply signed Power of Attorney must be submitted. There is no need to legalize or notarize this document. 

If priority is requested, a certified copy of the priority document and a Danish translation of this document must be submitted.

The substantive examination of an industrial design registration application in Denmark is not stipulated.

Validity period and renewal of industrial designs in Denmark

The renewal period for the novelty of an industrial design in Denmark is one year before the priority date. 

Official licensing fees or annual industrial design maintenance fees are not regulated in Denmark. The validity period of an industrial design in Denmark is 25 years from the filing date, provided it is renewed every five years. For spare parts, the term of validity is 15 years.
