Registration of industrial designs in Azerbaijan – Every company that owns an industrial design and intends to expand its business in the Azerbaijani market should use the Azerbaijani intellectual property system. It is paramount for businesses to file an industrial design application in Azerbaijan for industrial designs, even if the launch of the respective product in the Azerbaijan market has not yet commenced.
Requirements for application for registration of industrial designs in Azerbaijan
The time limit for filing an industrial design application for priority rights in Azerbaijan is 6 months from the date of priority. This deadline can be extended for 2 months.
The official language when registering an industrial design at the Azerbaijan Intellectual Property Office is Azerbaijani. Design applications may be filed in any language; however, an English translation certified by the applicant or the translator must be submitted within 2 months of the date of application.
The following information and documents need to be provided in the application for registration of an industrial design in Azerbaijan:

- name, address, and nationality of the applicant, business address;
- industrial design name;
- design drawings;
- description of the industrial design.
A certified copy of the Priority Document must be submitted within 3 months of application.
A signed and stamped power of attorney must be submitted within 2 months from the date of application in Azerbaijan. The power of attorney must be stamped regardless of whether the applicant is a natural or a legal entity. If there is no stamp, it must be notarized.
Examination of industrial design applications in Azerbaijan
The patent office conducts substantive examination upon request by the applicant or any interested party submitted within 18 months of the filing date.
Validity period and renewal of industrial designs in Azerbaijan
If design information is disclosed by the applicant, the designer, and a third party directly or indirectly obtaining such information, within 6 months before the date of application, such disclosure does not remove the novelty of the design.
The official license fee, as well as the first annual maintenance fee after the date of issue, must be paid within 2 months of the expiration of the deadline to object to published applications. The time limit for filing an objection is 6 months from the date of publication of the application.
The validity period of an industrial design patent in Azerbaijan is 10 years from the filing date and can be extended for another 5 years. The maintenance fee needs to be paid from the third year from the date of application but is payable only after a successful registration. Maintenance fees for subsequent years must be paid before the annual filing date.
