The deadline for entering the Chilean national stage of a PCT application is 30 months from the priority date, with the option to request reinstatement of rights if this deadline is missed, provided supporting evidence is submitted. The request for reinstatement must be made within two months after the cause for non-compliance ceases or twelve months from the expiration of the 30-month term from the international filing date.
PCT patent filling requirements in Chile
The official language for a Chilean patent application is Spanish. If the international application was submitted in a language other than Spanish, a Spanish translation must be provided within 30 days of entering the Chilean PCT national phase.
Submission of the original Power of Attorney is required, but it can be provided within 60 days of entering the Chilean PCT national phase. If the inventor is not the applicant, a notarized Assignment Deed must be submitted within 30 days of entering the Chilean PCT national phase.
A request for substantive examination in Chile must be filed within 60 days after the expiry of the opposition period, which is 45 days from the publication of the application.
There is a grace period of six months before the filing of the application where certain disclosures, such as practical tests and construction of mechanisms, exhibition of the invention in recognized exhibitions, and instances of abusive practices, will not affect the novelty of the invention.
The official grant fee for a Chilean patent should be paid within 60 days of receiving the notice of allowance. Patents in Chile are valid for twenty years from the filing date. Maintenance fees are paid twice, with the first-decade fee due upon acceptance of the application. The second-decade fee can be paid annually or as a one-time payment before the first-decade expiration. Late payment is allowed within a grace period of six months from the due date, subject to a surcharge.
Foreigners are required to appoint a registered Chilean patent attorney as an agent for entering the Chilean national phase of a PCT application.
