Registration of industrial designs in Hungary – Every company that owns an industrial design and intends to expand its business in the Hungary market should use the Hungary intellectual property system. It is paramount for businesses to file an industrial design application in Hungary for industrial designs, even if the launch of the respective product on the market in Hungary has not yet commenced. 

Requirements for Industrial Design Registration Application in Hungary 

An industrial design application in Hungary requesting the right of priority must be filed within 6 months from the priority date. 

Hungarian is the official language of proceedings in the Hungarian Intellectual Property Office (HIPO).

The following information and documents need to be provided in the application for registration of an industrial design in Hungary: 

  • name, address, and nationality of the applicant, business address; 
  • request for design registration;
  • representation of a design.
The original of the Priority Document must be filed within four months after the filing date.
A simply signed Power of Attorney must be submitted to the HIPO.
If the applicant is not the originator of the industrial design, an Assignment Deed verifying the applicant’s authority to apply must be filed.
Convention priority must be asserted within six months after the priority date.

Examination of an industrial design application in Hungary

In Hungary, design applications are automatically examined by the Office. Formal and substantive examinations are part of the examination process. The Office will also undertake a novelty search and notify the applicant of the results.

Validity period and renewal of industrial designs in Hungary

In Hungary, the novelty grace period is 12 months for the following disclosures:
  • the disclosure was made by the applicant, his predecessor in title, or a third party if the information was provided by the applicant or his predecessor in title;
  • the disclosure was made by the applicant, his predecessor in title, or a third party if the information was provided by the applicant or his predecessor in title.
Furthermore, a disclosure would be disregarded if the design was revealed to a third party under confidentiality conditions.
In addition to the application fee, no official grant fee is required. In Hungary, a registered design is valid for five years from the date of filing. Design registration may be renewed four times for additional five-year periods, with a maximum protection duration of 25 years from the filing date. The request for renewal must be submitted six months before the validity term expires, or within a six-month grace period.
Normally, the granting time does not exceed 8 months from the filing date.
