Vietnam: Six solutions to help develop intellectual property

In the context that the development potential of an economy based on raw resources and a source of cheap labor is more and more narrow, Vietnam must pay attention to intellectual property development and view it as an inseparable factor in economic and social development policies. Accordingly, Vietnam has proposed six solutions with the goal of helping intellectual property become an essential tool in the innovation system for improving competitiveness and promoting socio-economic development.

Intellectual property development in Vietnam

Over the past time, many guidelines and policies have been promulgated by the Party and Government to promote the construction, management, and development of the intellectual property, such as Resolution No. 20-NQ/TW on 1/11/2012 of the 11th party central committee on the development of science and technology to serve industrialization and modernization in the context of market economy-oriented socialist and International Economic Integration; Resolution No. 52-NQ/TW on 27/9/ 2019 of the 12th Politburo on some guidelines and policies about actively participating in the Fourth Industrial Revolution; Decision No. 1068/QD-TTG on 22/8/ 2019 of the Prime Minister on approving the strategy of the intellectual property until 2030. The intellectual property development program for the period 2011 – 2020 was approved in Decisions No. 2204/QD-TTG on 6/12/ 2010 and No. 1062/QD-TTG on 14/6/ 2016 of the Prime Minister.

From 2011 to 2020, the Ministry, Committee, and Sectors have actively implemented many specific activities for intellectual property development. It has created a new direction in the implementation of activities to support the community and enterprises in creating, managing, protecting, and developing intellectual property to contribute to promoting socio-economic development in a sustainable way.

The program of intellectual property development for the 2016-2020 period has long-term and pervasive effects. Hanoi, the capital of Vietnam, has 1,697 registration fillings of patent, 834 utility solutions, 2,221 industrial designs, and 61,491 trademarks. The city has supported creating and managing certification and collective marks for 64 agricultural products and craft village products. Moreover, Ha Noi endorsed the management and development of intellectual property protection for four collective brands.

The Hanoi City People’s Committee has issued a program to develop intellectual property to have 100% of the city’s universities and colleges propagated, trained, and upgraded awareness of intellectual property by 2030; at least 50% of the area’s enterprises propagated, trained, and raised awareness of intellectual property; the number of patent registration fillings will increase by 16-18% per year on average; products associated with the Program One Commune One Product (OCOP Program), Hanoi city will strive to reach at least 40% by 2025 and at least 60% of products by 2025 supported for intellectual property registration, management, and development, as well as the origin and quality control.

Six proposed solutions

From the goals set by the program in this period, the Hanoi Department of Science and Technology has presented six solutions as follows:

Firstly, strengthen activities to create intellectual property, improve the quality of resources on innovation and intellectual property;

Second, encourage registration of intellectual property protection at domestic and Foreign;

Third, improve the efficiency of management, exploitation, and development of intellectual property;

Fourth, promote and strengthen the effective enforcement and prevention of intellectual property rights infringement;

Fifth, expand and strengthen the capacity of intermediary organizations and intellectual property rights holders;

Finally, form and create a culture of intellectual property in society.
